We are very grateful for the trust that our users show when they share their information with us. We take our responsibilities as guardians of that information very seriously. At the same time, we are also committed to complying with applicable laws and legal processes by which we are bound, including by complying with information access requests from law enforcement agencies where we are legally obliged to do so. This policy sets out how we assess and respond to requests we receive from law enforcement agencies for access to user information.
How can law enforcement agencies request information from us?
We operate a global business. Law enforcement agencies should direct requests to us as follows:

While we appreciate that different requests will be in different forms, in order to help us properly assess each request, we ask that they be submitted in English with at least the following information:
· details of the agency that is making the request
· details of the law under which the request is made
· the name, identification number and direct contact details for the person at the agency who authorised the request.
If it is different, the name, identification number and direct contact details for the person who is authorised to receive the information requested.
· a specific description of the information that is the subject of the request. If the request is for data that includes personally identifiable information, please provide an exhaustive list of all data requested. Any data not on the list will not be provided.
· the time by which the request must be complied with
How does Linktree handle domestication and international legal requests?
Any individual or entity issuing legal process or legal information requests (e.g., discovery requests, warrants, or subpoenas) to Linktree must ensure that the process or request is properly domesticated.
For data stored in the United States or Australia, Linktree does not accept legal process or requests directly from law enforcement entities outside of these jurisdictions. Foreign law enforcement agencies seeking data stored within the U.S. or Australia must proceed through the Mutual Legal Assistance Treaty (MLAT) process or other appropriate diplomatic or legal channels to obtain data through a court where Linktree is located.
Requests directed to Linktree Pty Ltd, an Australian company, must be issued out of or domesticated in Australia, while requests directed to Linktree USA, Inc. must be issued out of or domesticated in the United States.
How will we assess and respond to law enforcement access requests?
We will carefully consider each request we receive from a law enforcement agency, to confirm that the request has been validly issued, that the request has a substantiated legal basis and is binding on us. If we have concerns, we may ask for further information from the issuing agency before completing our assessment.
Unless we are prohibited by law from doing so, we will generally contact the user in question before disclosing user information in response to a request from a law enforcement agency. We ask that the issuing agency notify us in advance, with supporting details, if there is a legal basis for no contact with the user.
If we determine that we are obliged to disclose user information in response to a request from a law enforcement agency, we will take care to ensure that we do not disclose information beyond what is legally required.
If complying with a request from a law enforcement agency is likely to result in us incurring material costs, we reserve the right to seek reimbursement for those costs.
What about emergency situations?
In rare cases, where we reasonably believe that it is necessary to do so in order to lessen or prevent a serious threat to the life, health or safety of any individual, we may provide user information to law enforcement agencies without a formal binding request. We do not make such decisions lightly, and will only pursue this course of action where we consider there is a genuine emergency.
